These Terms govern your access to and use of the Shankara Australia & New Zealand website, products and services (“Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

You must be at least 16 to use the Site. If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activities under your account.

1. Product information: We aim to ensure accuracy, but images, descriptions, and availability may change without notice.
2. Orders: An order is an offer to buy. We may accept or reject any order (e.g., due to availability, suspected fraud, pricing errors). Your order is accepted when we send an order confirmation email.
3. Pricing & taxes: Prices are shown in AUD/NZD as applicable and include GST (AU) or GST (NZ) unless stated otherwise.
4. Errors: If a product is listed at an incorrect price or with incorrect information, we may cancel the order and refund any amounts paid.
5. Promotions: Promotions and discount codes are subject to their stated terms and may be modified or withdrawn at any time.
6. Delivery: Risk in goods passes on delivery to your nominated address. Timeframes are estimates only. See our Shipping Policy for details.
7. Returns & refunds: See our Returns & Exchanges Policy for the process and timeframes. Your statutory rights are not affected.

Nothing in these Terms limits any rights you have under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993 (together, “Consumer Laws”). You are entitled to a replacement or refund for a major failure and to have goods repaired or replaced if they fail to be of acceptable quality.

To the extent permitted by law, and other than the Consumer Laws, we exclude all warranties, representations and guarantees (express or implied) relating to the Site and products.

To the extent permitted by law, our liability for any claim arising out of or in connection with these Terms, the Site or any products is limited, at our option, to:

• in the case of goods: replacement or repair of the goods, supply of equivalent goods, or payment of the cost of doing so; and
• in the case of services: resupply of the services or payment of the cost of resupply.

We are not liable for any loss of profit, revenue, goodwill, or any indirect or consequential loss, except where liability cannot be excluded under Consumer Laws.

You must not misuse the Site. This includes uploading or transmitting unlawful, defamatory, misleading, infringing, or harmful content; interfering with the Site’s security or operation; or engaging in spamming, scraping, or data mining without permission. We may suspend or terminate access at our discretion.

All content on the Site (including text, graphics, logos, images, video, code, and design) is owned by or licensed to us and is protected by applicable copyright, design, and trademark laws. You may view, print or download content for personal, non-commercial use only. You must not reproduce, distribute, adapt, or create derivative works without our prior written consent. Shankara® and related marks are trademarks of their respective owners.

If you submit reviews, comments, photos, or other content (“User Content”), you grant us a non-exclusive, royalty-free, transferable, sub-licensable worldwide licence to use, reproduce, modify, publish and display that content in connection with the Site, marketing and social media. You warrant you own or control the rights to your User Content and that it is accurate, lawful and non-infringing. We may edit or remove User Content at our discretion.

1. Opt-in: If you opt in to receive SMS or email from us, you consent to receive marketing and transactional messages to the contact details you provide. Message/data rates may apply. Frequency varies.
2. Opt-out: You can unsubscribe from email via the “Unsubscribe” link in any email. You can opt out of SMS by replying STOP (or using any equivalent supported command) or by contacting us at support@shankara.com.au.
3. Compliance: We follow the Spam Act 2003 (Cth) and the Unsolicited Electronic Messages Act 2007 (NZ). Consent is required for marketing messages, and you can withdraw consent at any time.
4. Program availability: Messaging services are provided “as is” and may be affected by carrier changes or outages. We are not responsible for delays or failures in message delivery beyond our reasonable control.

The Site may contain links or integrations to third-party websites or services (e.g., payment providers, review platforms, social networks). We are not responsible for third-party content, policies or practices. Your use of third-party services is at your own risk and subject to their terms.

Our handling of personal information is described in our Privacy Policy (ANZ). By using the Site, you acknowledge that we will collect, use and disclose personal information in accordance with that policy.

Our products and content are for cosmetic and general wellness purposes only and are not intended to diagnose, treat, cure or prevent any disease. Individual results vary. Always follow product directions and patch-test first. Seek advice from a qualified professional regarding any health concerns.

We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, labour disputes, epidemics, carrier issues, or disruptions to utilities or communications.

We may update the Site and these Terms from time to time. The “Last updated” date indicates the latest version. If you continue to use the Site after changes take effect, you agree to the updated Terms.

For Australian customers: These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

For New Zealand customers: These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the courts of New Zealand.
